WHO FILES THE CHARGE
City Attorney for misdemeanors, DA for felonies
The Burbank City Attorney’s Office says it prosecutes state and local misdemeanor crimes that occur within Burbank. Its Prosecution Unit lists DUI among the state misdemeanors it handles, along with city ordinance violations.
The office also says it cannot represent individuals in private legal matters. Its attorneys represent the City, so in a DUI case they are the prosecution.
Felony crimes in Los Angeles County, including those in Burbank, are prosecuted by the Los Angeles County District Attorney. The District Attorney’s Burbank Satellite Office is inside the Burbank Courthouse, in Room 215.
Whether a DUI is charged as a misdemeanor or a felony depends on the facts. Some injury cases and some repeat offenses can be charged as felonies.
