How the 10 days are counted

After a DUI arrest in California, the officer usually takes your license and gives you a pink notice: an Order of Suspension and Temporary Driver License. To have a DMV hearing before the suspension starts, you must request it within 10 days of receiving that notice.

  • The day after you receive the notice is Day 1. Weekends and holidays count.
  • If you took a blood test, the notice may arrive later by mail. The 10 days count from the day you receive it.
  • The pink notice usually works as a temporary license for 30 days.
  • The DMV case (your license) and the court case are separate. The DMV can suspend your license even before your first court date.
