Fresno DUI Lawyer
In Fresno County, a DUI is a criminal case, and the court’s felony and misdemeanor court is on Van Ness Avenue downtown.
DUI DEFENSE FOR FRESNO COUNTY ARRESTS
Two court buildings, two kinds of cases
Fresno has a courthouse called the “M” Street Courthouse, but its address is 2317 Tuolumne Street. The court lists traffic infractions and criminal infractions there. A DUI is charged as a misdemeanor or a felony, not as an infraction.
The court lists no adult criminal courthouse outside downtown Fresno. So an arrest in Clovis, Selma, Reedley, or Coalinga is generally handled downtown as well. The court named on your citation or release papers is the one that counts.
Our published results include three DMV hearings recorded under Fresno, from 2025 to 2026. Our only office is in Los Angeles, at 3810 Wilshire Blvd.

The DA also has a DUI prosecution team funded by the California Office of Traffic Safety (OTS). The DA says 2023 to 2024 was the 20th year of that funding.

YOUR DRIVER’S LICENSE
What changed at the DMV in Fresno
The license case runs separately from the court case, and a DMV hearing officer decides it rather than a judge.
NOVEMBER 1, 2024
Closure announced
The DMV announced that its Fresno Driver Safety office at 2510 S. East Ave. would close. The release said most Driver Safety hearings are now conducted virtually.
NOVEMBER 8, 2024
The Fresno office closed
The office closed at 5 p.m. that day. The DMV said Fresno hearing officers would be reassigned to nearby DMV locations. Drivers who needed an in-person hearing could make an appointment online or by phone. At the time, the DMV named the Fresno North, Madera, and Visalia field offices as the nearest places.
APRIL 2026
The current office list
The DMV’s hearing guide, revised in April 2026, lists 10 Driver Safety offices. Fresno is not one of them.
AFTER A NEW ARREST
Ask within 10 days
If you want a DMV hearing before the suspension takes effect, request it within 10 days of receiving the DMV notice. The notice is usually handed to you at the arrest. Requests go to Driver Safety by phone at (833) 543-7703 or through the DMV’s online portal.
REPEAT MISDEMEANOR DUI
The Fresno County DUI Court
The Fresno County DUI Court is a program for defendants charged with a repeat misdemeanor DUI who are assessed as high-risk. Defendants first appear in their regular home court department, where they receive information about the program.
Those who want to take part are screened by the DUI Court team. Participants plead guilty to the DUI charges. A jail sentence is imposed and stayed, and they begin supervision and treatment.
The court describes two tracks. One focuses on treatment for addiction. The other focuses on compliance and monitoring for repeat offenders with little or no addiction.
Participants must start using an alcohol monitoring device within 5 days of sentencing. The DUI Court meets on Thursdays in Department 97B, phone (559) 457-6362.
LOCAL NUMBERS
DUI arrests in the county
In 2021, Fresno County had 3,996 DUI arrests (DMV DUI-MIS report). That was 0.6 arrests per 100 licensed drivers, or 1.5 times the statewide rate of 0.4. The county’s arrests fell 7.3% from 2020.
For 2023, the Office of Traffic Safety (OTS) crash rankings list 760 people killed or injured in alcohol-involved crashes in Fresno County. They list 1,516 DUI arrests for the City of Fresno.
OTS shows DUI arrest figures for cities only, not counties. It says its rankings are only indicators of potential problems.
DMV RESULTS
DMV hearings recorded under Fresno
These are three DMV hearings on our Success Stories page, from 2025 to 2026, that our records list under Fresno. “Fresno” is the label in our records; the Fresno Driver Safety office had closed in November 2024. In each case, the DMV hearing officer set aside the DMV action against the driver’s license. A set-aside is a DMV license decision, not a result in court. Two of the three were reexamination hearings, not DUI suspension hearings.
